Google Loses Appeal in Epic Games Antitrust Battle

Google has suffered a significant legal setback after the 9th U.S. Circuit Court of Appeals rejected its attempt to overturn a court order mandating a complete overhaul of its app store. The ruling marks a major development in the ongoing antitrust litigation initiated by Fortnite developer Epic Games.

The appeals court dismissed claims from the tech giant that the presiding trial judge committed legal errors during the proceedings. Google had specifically argued that the court unfairly restricted its defense by preventing it from demonstrating how the Play Store maintains competition against Apple’s ecosystem.

The Road to the Ruling

The conflict traces back to 2020, when Epic Games first filed its lawsuit. Following years of legal maneuvering, a jury ruled in 2023 that Google had engaged in illegal practices to stifle market competition. As a result of that verdict, the trial judge issued a directive in October requiring the company to:

• Open the Google Play Store to third-party competitors.
• Provide Android users with broader options for downloading and installing applications.

This mandate had been effectively paused while the appeals process was underway.
