Epic Games Begins $72M Refund Payouts to Fortnite Users

The U.S. Federal Trade Commission (FTC) confirmed on Monday that it has initiated the first wave of refund distributions to Fortnite players who were misled into making accidental purchases. The total payout for this initial phase exceeds $72 million.

This distribution stems from a settlement finalized in March 2023, following a $245 million fine levied against Epic Games. The commission determined that the game utilized “counterintuitive, inconsistent, and confusing button configuration” that frequently caused users to trigger charges unintentionally.

Addressing Deceptive Design Tactics

The FTC highlighted that these practices, often categorized as “dark patterns,” were particularly harmful to younger players. Investigators found that the interface design led to unauthorized charges occurring without parental oversight. Common scenarios that resulted in these charges included:

• Charges occurring while the game was still loading after being in sleep mode.
• Purchases triggered simply by pressing a button intended to preview an item.

The commission has increasingly prioritized the crackdown on such digital design tricks. Recent enforcement actions have targeted various sectors, including neobanks and major retailers like Amazon, for deploying similar tactics to deceive users into subscriptions or unwanted digital transactions.

Settlement Terms and Payment Details

Beyond the $72 million in refunds, the agreement mandates significant changes to how Epic Games handles digital commerce. The developer is now required to obtain affirmative consent for all digital purchases and is prohibited from locking accounts belonging to users who dispute charges.

Regarding the current refund process, the FTC provided the following breakdown:

• A total of 629,344 payments are being issued in this initial round.
• Distributions are split between PayPal transfers and mailed checks.
• The average individual refund amount is approximately $114.

Recipients are urged to act promptly: PayPal payments must be redeemed within 30 days, and checks must be cashed within 90 days. The agency noted that this is only the first phase of the total refund plan. Consumers who have not yet sought reimbursement may still submit a claim via an online form to be considered for future payments.
