Fortnite is poised to make a comeback on the U.S. iOS App Store as early as next week following a significant legal setback for Apple. Judge Yvonne Gonzalez Rogers ruled on Wednesday that the technology giant acted in “willful violation” of a 2021 injunction intended to curb anticompetitive pricing practices.

The court’s decision centers on Apple’s failure to adhere to mandates requiring the company to allow developers to direct users toward external websites for in-app purchases. Rather than complying, the judge noted that Apple intentionally erected new barriers to maintain its control over payment ecosystems.

Legal Consequences and Contempt

Judge Rogers did not mince words regarding Apple’s conduct, stating, “That it thought this Court would tolerate such insubordination was a gross miscalculation. As always, the coverup made it worse. For this Court, there is no second bite at the apple.”

The severity of the ruling extends beyond a simple directive. Judge Rogers has referred the matter to the U.S. Attorney for the Northern District of California, requesting a review for potential criminal contempt proceedings against the iPhone manufacturer.

While Apple has confirmed it will comply with the order, the company remains defiant. An Apple spokesperson stated, “We strongly disagree with the decision. We will comply with the court’s order and we will appeal.”

Epic Games CEO Tim Sweeney utilized the social platform X to confirm the timeline for Fortnite’s return. Furthermore, Sweeney proposed an olive branch to the tech giant:

• If Apple applies the court’s “friction-free, Apple-tax-free” framework on a global scale, Epic Games will restore Fortnite to the App Store worldwide.
• In exchange, Epic Games would drop all current and future litigation regarding these specific App Store policies.
